1. Definition
A conditional contract is a mechanism for the BSC to attempt to resolve conduct and/or safety issues by establishing a behavioral contract that outlines expectations and specifies that a member’s continued membership in the BSC is contingent upon specific aspects of the member’s behavior. For instance, a conditional contract may require that a member refrain from violating the smoking policy in section 25 of the BSC contract, and that failing to do so will result in membership termination.
The central level supervisors that may issue a staff-issued conditional contract are the Conduct Hearing Coordinator, Cooperative Experience Manager, the Member Resources Supervisor, the Operations Manager, the Rochdale & Fenwick Apartment Manager, the Cloyne Court Facilities Manager, and the Executive Director.

2. Procedure
The central level supervisor who is assigned to respond to the initial conduct or safety concern will assume the responsibility of issuing the conditional contract. A member has the option to accept the central-level supervisor’s contract subject to all the rights under Policy Directory VII.K.3 or to take the case before the appropriate Enforcement Committee.

3. Member Rights
A member and central-level supervisor may mutually choose to address a conduct issue with a staff-issued conditional contract provided that the following conditions are met:

:A. The staff-issued conditional contract will be offered only after the central-level supervisor has researched both sides of the issue.

:B. A member does not have to sign the staff-issued conditional contract. No member shall ever be terminated solely for refusing to sign a staff-issued conditional contract. In some cases, signing a staff-issued conditional contract may be beneficial to the member due to either privacy or expediency reasons, but it is always a member’s choice, and their refusal to sign may not be used against them.

:C. The central-level supervisor will review each condition of the conditional contract with the member to ensure mutual understanding. The issuing staff member must fully brief the member that it is optional to sign the conditional contract.

:D. The member shall have a chance to respond to each condition, and may ask that overly ambiguous conditions be rephrased in more specific language. The central-level supervisor will make a good- faith effort to honor any requests for clearer language in cases when it is reasonably possible to do so.

:E. The member may also object to certain conditions and state reasons for the objections. It is at the discretion of the central-level supervisor to remove conditions based on the member’s objections.

:F. The member will have at least 72 hours to decide whether to sign the staff-issued conditional contract.

:G. The Conduct Member Advisor will be an available resource to help advise the member, including helping to clarify the terms of the staff-issued conditional contract and any concerns the member might have. If the two Conduct Member Advisors are not available as a resource in the 72-hour time frame or if there is a conflict-of-interest, then the central-level supervisor may extend the 72 hour timeframe and/or shall make a good faith effort to locate and reimburse a substitute Conduct Member Advisor.

:H. If the member chooses not to sign the staff-issued contract, the issue will be referred to the appropriate Enforcement Committee for consideration. For instance, if a member has been violating the smoking policy, the issue will be referred to the Conduct Committee. It is not possible to predict in advance how the Enforcement Committee will adjudicate the issue (e.g. the committee could dismiss the issue, decide to issue a conditional contract, or decide to terminate the member.)

:I. Before signing a staff-issued conditional contract, the member shall be informed of conditions A through H in writing and shall explicitly initial each condition to indicate that this right has been explained to them.

VII.Q. BSC Anti-Bullying Policy

I. Policy Statement & Definition:
:A. The BSC strives to create and maintain a community in which people are treated with dignity, decency, and respect. The BSC community should be characterized by mutual trust and the absence of intimidation, degradation, or humiliation. Members should be able to live, board, and learn in a safe and stimulating environment. The accomplishment of this goal is essential to fulfilling the mission of the BSC. For that reason, the BSC will not tolerate abusive behavior and/or bullying of any kind. Through enforcement of this policy and through the education of members and guests, the BSC will seek to prevent, correct, and discipline behavior that violates this policy.
:B. The BSC defines abusive and/or bullying behavior as persistent, malicious, unwelcome, severe and pervasive mistreatment that harms, intimidates, offends, degrades or humiliates a member whether physical, verbal, written, graphic, in person or via electronic messages or media posted or circulated in any form in the BSC community.
:C. The BSC promotes and is committed to providing a safe and cooperative community and strictly prohibits abusive conduct and bullying.

II. Applicability
:A. All members, guests, alumni, and third-parties conducting business with the BSC are expected to comply with this policy, and to take appropriate measures to ensure that prohibited conduct does not occur. Appropriate disciplinary action will be taken against any member, guest, alumni, or third-party that violates this policy. Based upon the seriousness of the offense and the nature of the individual’s relationship with the BSC, disciplinary action may include a warning, educational sanctions, a conditional contract, membership termination, ineligibility to visit BSC property, and/or ineligibility to conduct business with the BSC.
:B. Please see the BSC Harassment Policy for policies and procedures governing inappropriate conduct predicated on an individual or group’s protected status.
:C. Please see the Anti-Bullying & Abusive Conduct Prevention Policy in the BSC Employee Handbook for relevant policies providing protections and outlining expectations and accountability for BSC student and professional staff in the workplace.

III. Examples of Prohibited Abusive Conduct and/or Bullying
:A. The BSC prohibits abusive conduct and/or bullying behavior that a reasonable person would find:
::i. Has the purpose or effect of creating an intimidating, hostile, or offensive educational, living, or boarding environment; or
::ii. Has the purpose or effect of unreasonably interfering with an individual’s academic performance or their ability to exercise their rights and/or fulfill their responsibilities as a BSC member, guest, alumni, or third party providing services within the BSC community.

:B. Examples of unacceptable behavior (whether physical, verbal, written, graphic, electronic messages or media posted or circulated in the community) include the following types of conduct:
::i. Repeated infliction of verbal abuse, such as the use of derogatory remarks, insults, epithets, persistent or egregious use of abusive, insulting, or offensive language.
::ii. Staring, glaring or other nonverbal demonstrations of hostility as a pattern of other behaviors consistent with this policy.
::iii. Personal attacks, behavior, or language that frightens, humiliates, belittles, or degrades, including criticism or feedback that is delivered with yelling, screaming, threats, or insults.
::iv. Gratuitously insulting another person or their performance, especially in front of others.
::v. Spreading misinformation or malicious rumors.
::vi. Making repeated inappropriate comments about a person's appearance, lifestyle, family, or culture.
::vii. Regularly inappropriately teasing or making someone the brunt of pranks or practical jokes.
::viii. Inappropriately interfering with a person's personal property or work equipment.
::ix. Circulating inappropriate or embarrassing photos or videos via e-mail or social media.
::x. Unwarranted physical contact.
::xi. Purposefully and inappropriately excluding, isolating, or marginalizing a person from unit or BSC-wide activities.
::xii. Consistent ignoring or interrupting of a member.
::xiii. Encouragement of others to turn against a targeted member.
::xiv. Invasion of another’s person’s personal space.
::xv. Unreasonable interference with an member’s ability to study or do their workshift.
::xvi. Conduct that a reasonable person would find hostile and offensive.

IV. Reporting Abusive Conduct and/or Bullying & Enforcement
:A. If any member, guest, alum, or third-party conducting business with the BSC feels that they are being subject to abusive conduct or bullying or if they observe abusive conduct or bullying by another member, guest, alum, or third-party doing business with the BSC, they should immediately report the incident to a member of their unit-level manager team, the Cooperative Experience Manager, or the Member Resources Supervisor in order for appropriate action to be taken.
:B. Early reporting and intervention have proven to be the most effective method of resolving actual or perceived incidents of bullying. The BSC will make every effort to stop bullying before it becomes severe or pervasive, but can only do so with the cooperation of members of the BSC community.
:C. In order for the BSC to investigate and try to resolve complaints internally, all parties must promptly report complaints of misconduct under this policy to the Cooperative Experience Manager or the Member Resources Supervisor. All complaints should be submitted via the BSC Conduct Complaint Form, via email, or by calling (510) 848-1936. All complaints of abusive conduct and bullying that are reported will be investigated as promptly as possible and corrective action will be taken where warranted.
:D. The investigation and resolution of complaints will be conducted in accordance with:
::i. The BSC Grievance Procedure (for current BSC members)
::ii. The BSC Central Level PNG Policy (for alumni, guests, or third-party conducting business with the BSC)

V. Direct Communication
The availability of this complaint procedure does not preclude individuals who believe they are being subjected to abusive behavior and/or bullying from promptly advising the offender that their behavior is unwelcome and requesting that such behavior immediately stop.

BSC Programs Board

The Programs Board is responsible for planning and executing BSC-wide programming in order to foster member education and engagement across the entire organization. Additionally, the Programs Board is responsible for encouraging BSC-wide community building by fostering co-oper pan identity within the membership. Specifically, the Programs Board should strive to coordinate a minimum of five events each academic year that are social and/or educational in nature. By doing this, the Programs Board should also strive to develop events that are both well-attended and well-received by the BSC membership.

:1. Duties and Responsibilities of the Programs Board
::a. The Programs Board shall work work directly with the the Member Resources Coordinator (MRC) primary, and when necessary shall work with Cooperative Experience Manager (CExM), and other relevant parties within and outside the organization, in order to fulfill its duties as a programming body. They will consult with the Member Resources Coordinator on what sort of programming should be planned and executed in a given contract period. In addition, they will work with the Member Resources Department to both advertise and execute the events developed by the Programs Board.
::b. The Programs Board shall be supervised by the Member Resources Coordinator. The Programs Board will be chaired by the Social Manager Coordinator (SMC) who will be tasked with facilitating meetings, maintaining communication between parties, supervising the Programs Board, and ensuring that programming is being planned and executed.
::c. At the beginning of the Fall and Spring contract period, the Programs Board will develop a semester-long program calendar with the Member Resources Coordinator. The program calendar should outline the Programs Board’s events for the respective contract period and include itemized budgets for each event. Additional funding may be provided by ETCom or other available funds from other external sources.
::d. The Programs Board shall have a Programming Budget in order to coordinate and execute events developed by the Programs Board. The Programs Board and Member Resources Coordinator shall have total discretion on how the budget is spent, but it must be approved by the Member Resources Coordinator. Additional funds may be provided by other budgets, but must be brought forward to the Member Resources Coordinator. In addition, they should solicit funds from units in the case that multiple units are collaborating for a major inter-unit event.
:2. Composition and Compensation of the Programs Board
::a. The Programs Board shall be composed by the following: the Member Resources Coordinator, the Social Manager Coordinator and (3-4) members, preferencing current and/or former Social Managers from the entire organization.
V.I.I.A. BSC Guidelines on Accommodating Service and Assistance Animals
The BSC is committed to reaching out and providing services to students with disabilities in an effort to create an equal opportunity for all students to enjoy and participate in BSC’s community life. Reasonable and appropriate accommodations are extended to eligible members on an individualized, case-by-case basis.

Members with disabilities, and those with questions regarding eligibility criteria and/or available services, are encouraged to contact the Housing department at (510) 848-1936 or housing@bsc.coop.

Service and Assistance Animals Policy

This policy applies to service and assistance animals that may be used by individuals with disabilities at the Berkeley Student Cooperative. A service animal is an animal that either works, provides assistance, or performs tasks for the benefit of a person with a disability. An assistance animal provides emotional or other type of support that alleviates one or more identified symptoms or effects of a person's disability.

Service Animals

A "service animal" refers to a dog or miniature horse that is individually trained to do work or perform tasks for the benefit of a person with a disability. The work or tasks performed by a service animal must be directly related to the person's disability. The provision of emotional support, well-being, comfort, or companionship does not constitute work or tasks for the purpose of this definition. Service dogs are permitted to accompany people with disabilities in all areas of the BSC facilities. Although students with service dogs are not required to register with the BSC Housing department, the BSC encourages students to contact the Housing department to learn what other services may be available to them.

When the disability and/or disability-related need for the animal are not readily apparent, the member may be required to document the disability and/or disability-related need for the animal.
The BSC is covered by both Title II of the ADA and the Federal Housing Act (FHAct). The U.S. Department of Housing and Development (HUD) memo (April 25, 2013) describes a two-step approach for responding to an accommodation request from a member with a disability seeking an exception to a no-pet policy in student housing environments. If the animal meets the ADA definition of a service animal (i.e. dog trained to perform service tasks), then the student may be asked two questions: (1) Is this a service animal that is required because of a disability? and (2) What work or tasks has the animal been trained to perform?

Assistance Animals

An "assistance animal" is an animal that provides emotional or other support that ameliorates one or more identified symptoms or effects of a person's disability. Unlike service animals, assistance animals are not required to be trained to perform work or tasks, and include species other than dogs and miniature horses. Students who intend to bring an assistance animal to the BSC must receive an accommodation through the BSC Housing department to do so. Accommodation requests to bring an assistance animal to live in BSC housing must be submitted to the BSC Housing department at time of application or 30 days prior to move in, whichever is sooner.

When a member with a disability is seeking permission to keep an animal (other than a trained service dog) in BSC housing, the correct way for members with disabilities to request permission to keep a live-in animal as an accommodation in BSC units includes four components:

:1. The Request placed with the BSC Housing Office
:2. Agreement to the Guidelines for Maintaining a Service or Assistance Animal within the BSC Community
:3. Roommate/Suitemate Agreement
:4. Service and Assistance Animal Registration Form

Guide and Hearing Trainees

California law allows animals that are being trained to be dog guides for the blind, hearing assistance dogs, or assistance animals for persons with physical impairments to access the BSC facilities.

Responsibilities of People with Disabilities Using Service or Assistance Animals

The BSC is not responsible for the care or supervision of service or assistance animals. People with disabilities are responsible for the cost, care, and supervision of service or assistance animals, including:

* Compliance with any laws pertaining to animal licensing, vaccination, and owner identification;
* Keeping the animal under control and taking effective action if it becomes out of control;
* One of your responsibilities is to ensure that your animal is flea free. If your animal has fleas and and we have to treat your bedroom or any common space in your unit for fleas, we will charge you the cost of the flea treatment that the pest control company charges us. This cost varies by treatment but is generally $135 per room.
* Feeding, walking, and providing ordinary care of the animal and the surrounding area; and
* Appropriately disposing of the animal’s waste.

Animal waste disposal via BSC plumbing is prohibited. BSC Housing will provide guidance on where to appropriately dispose of animal waste. The BSC will not require any surcharges or fees for service or assistance animals. However, a person with a disability may be charged for damage caused by a service or assistance animal to the same extent that the BSC would normally charge a person for the damage they cause. Members with disabilities and their service or assistance animals must comply with the same BSC rules regarding noise, safety, disruption, cleanliness and habitability as members without disabilities.

Exceptions and Exclusions

The BSC may pose some restrictions on, and may even exclude a service or assistance animal in certain instances. Reasons an animal may be excluded from an area include but are not limited to:

: - An assistance animal may be excluded from commercial kitchen, dining, and other common areas due to health and safety standards and accessibility needs of members with allergies. This provision does not apply to service animals.
: - It is out of control and effective action is not taken to control it.
: - It is not housebroken (or in the case of an assistance animal that deposits waste in a designated cage or litter box, the owner fails to clean such cage or box such that the cleanliness of the room is not maintained);
: - It poses a direct threat to the health or safety of others that cannot be mitigated by
reasonable modifications of policies, practices, or procedures, or the provision of auxiliary aids or services.

In the event that restriction or removal of a service or assistance animal is determined to be necessary, the person with a disability will still be given the opportunity to participate in the service, program, or activity without having the service or assistance animal present.

Guidelines for Members of the BSC Community

To ensure equal access and nondiscrimination of people with disabilities, members of the BSC community must abide by the following practices:
: - Allow service animals to accompany people with disabilities in all areas of BSC facilities available for members’ use.
: - Allow assistance animals to accompany members with disabilities in bedrooms and/or apartments where accommodations have been granted and any associated hallways/pathways needed for access.
: - Do not ask for details about a person's disabilities;
: - Do not pet a service or assistance animal, as it distracts the animal from its work;
: - Do not feed a service or assistance animal;
: - Do not deliberately startle, tease, or taunt a service or assistance animal; and
: - Do not separate or attempt to separate a person from their service or assistance animal.

If you have a disability that may be affected by the presence of animals, please contact the BSC Housing Department . The BSC is committed to ensuring that the needs of all people with disabilities are met and will determine how to resolve any conflicts or problems as expeditiously as possible.

V.I.I.B Guidelines for Requesting Accommodations for Members with Disabilities
The BSC is committed to reaching out to and providing services to members with disabilities in an effort to create an equal opportunity for all students to enjoy and participate in BSC’s community life.

1. SUBMITTING AN ACCOMMODATION REQUEST

Members with disabilities should provide information about their needs on their BSC membership profile, available at https://bsc.rms-inc.com. This information should be provided upon application to the BSC. If a member’s accessibility needs change during the course of membership, they should update the information in their member profile and notify the Housing Department so that appropriate accommodations can be made. These application requirements may be waived if, after reasonable assessment, the Housing Department Supervisor determines that certain accommodations are necessary.

In order to request an accommodation, members must complete and submit an Accommodations Request Form. The form has two components, including a short questionnaire to be completed by the member as part of the BSC’s on-line housing application. The second portion of the Form must be completed by the Disabled Students Program or other approved disability specialist. All information will be kept confidential and will only be used to determine reasonable housing and/or workshift accommodations.

2. PROVIDING DOCUMENTATION

In addition to completing the membership application, members must provide appropriate documentation from the Disabled Students Program or other approved disability specialist in a timely manner for their request to be considered complete.

Part Two of the Accommodation Request Form should be completed by a specialist in the Disabled Students’ Program office at the member’s college or university or an alternate, qualified disability specialist approved by the Housing Department. The specialist should indicate all recommended accommodations that apply, and must complete the written section which asks them to briefly describe the ways the member’s disability impacts their housing needs and/or ability to perform workshift.

The BSC Housing Supervisor, or their designee, will review all disability accommodation requests. Students may be contacted if clarification or additional documentation is needed.

3. RECEIVING A HOUSING AND/OR WORKSHIFT ASSIGNMENT

Once the form and documentation have been reviewed, the Housing Supervisor will determine a reasonable housing and/or workshift accommodation, and may offer an alternative accommodation that meets the student’s disability-related needs as described by the Disabled Students Program or other approved specialist. The Housing Supervisor is responsible for communicating housing and workshift accommodations to the member and to the member’s House/Apartment Manager (for Housing Accommodations). Members with workshift accommodations must share the email from Housing Department approving their workshift accommodation with their Workshift Manager so that appropriate workshift accommodations can be implemented at the unit-level.

Housing and/or workshift accommodations may ONLY be offered through the BSC Housing Department. Unit-level Managers must honor all verified accommodations as directed by the Housing Supervisor. Unit-level Managers may not independently offer housing and/or workshift accommodations.

a. HOUSING ACCOMMODATIONS

: Housing priority is given as outlined in BSC policy V: Assignment of Spaces and VII: Points and Assignment of Rooms.

: Members who receive a housing offer will be notified via email, to the email they provided to the BSC on their membership application form. There will be a limited time provided for the member to log on to the BSC Member Portal to view their housing offer and either accept or decline it. By declining the offer, the member is indicating that they do not wish to live in the BSC for the current term and they will not be guaranteed an offer for a difference space.

: If the member believes that the space they are offered does not address the functional limitations of their disability, they may reach out to the Housing Supervisor with additional information. However, this does not guarantee that a different space will be available to offer.

: If, during room bids, the member chooses a room different than the one provided to them by the BSC per their accommodation request, they forfeit their accommodation and must request it again should they decide they need it for future semesters. By forfeiting the offer, the member is indicating that they do not need the accommodation for the current term and they will not be guaranteed an offer for a difference space.

b. WORKSHIFT ACCOMMODATIONS

:Workshift accommodations are given per policy II.A.8 Workshifters and Disabilities. Accommodations related to a member’s workshift requirement may be either priority assignment for specific types of shifts/tasks to fulfill their workshift requirement and/or a reduction in workshift hours owed if no other accommodation can reasonably be provided.

:Members who receive a workshift accommodation offer will be notified via email, to the email they provided to the BSC on their membership application form. Members must share this information with their Workshift Manager prior to workshift assignments each term. If the member believes that the accommodation they are offered does not address the functional limitations of their disability, they may reach out to the Housing Supervisor with additional information.

4. EXAMPLES OF ACCOMMODATIONS MEMBERS MAY BE OFFERED THROUGH THE BSC:

:1. Automatic Door Opener
:2. Accessible bathroom (including roll in shower)
:3. Visual doorbell (typically for members with hearing impairments)
:4. Strobe light fire alarm/smoke detector (typically for members with hearing impairments)
:5. Rental of an additional space for a live-in attendant
:6. Room with elevator access
:7. Wheelchair accessible room
:8. Service or Assistance Animals (see BSC Guidelines)
:9. Priority selection of workshift tasks
:10. Reduced number of workshift hours owed per week

Members who have concerns about the housing and/or workshift accommodations they have been offered may make an appeal to the Operations Manager, who shall review the accommodation request and make a final determination regarding the accommodations the BSC is able to offer the member.

This is not an exhaustive list and we encourage members to get in touch with the Housing Department regarding specific questions about the type of accommodations available.

A. Preamble

The BSC Owner’s Manual is a foundational document that is meant to give any and all members the basic knowledge and tools to exercise ownership over their organization. It is valuable for the document and the program to be defined in policy in order to increase transparency about the program, allow for easier development of the program over time, and ensure that the Board is fulfilling its educational obligation to the membership.

B. Content
The BSC Owner’s Manual should contain enough content to equip members to effectively navigate their unit and the larger BSC. While this section is not meant to be prescriptive, the following topics should be considered by the
Member Resources Department and ETCom when creating the manual:
:1. Practical information that a new member would need in order to successfully interface with the Central Office, move in to their new house or apartment, stay safe, and carry out the day-‐to-‐day tasks of living in our organization.
:2. Information on decision-‐making processes, conflict management, and community-‐building.
:3. Organizational information, such as organizational and board structure, the relationship of the units to the central level, a guide to the various departments of the Central Office, and information about the Alumni Association.
:4. Background information on cooperatives, to help the member understand the history of cooperatives, cooperative principles, and the existence of the larger cooperative movement.
:5. A description of some of the most important policies that members may need to reference.
:6. A compendium of all the BSC units and their relevant information.
:7. Any extra “features” that might enhance the usefulness of the Owner’s Manual to members.

C. Creating the Owner’s Manual

:1. The Owner’s Manual is produced by the Member Resources department and subject to review by the Education and Training Committee. The Member Resources department will be primarily responsible for its content and form while the Education and Training Committee is responsible for reviewing the Owner’s Manual to ensure it meets member needs.
:2. In the Spring Semester, the Education and Training Committee will meet with the appropriate Member Resources staff member to review the previous year’s Owner’s Manual. The Education and Training Committee and the staff member will discuss potential content changes for the upcoming year and work together to establish goals. The Education and Training Committee will consider revisions to the Owner’s Manual using these guidelines:
::a. The Education and Training Committee should first consult the Member Education Framework and ensure that the priorities of the Owner’s Manual are in line with the priorities of the larger education framework.
::b. The Education and Training Committee should strive to collect feedback and ideas from as many sources as possible (members, managers, staff, external entities, etc.) when reviewing the content of the upcoming manual. The member resources assistant will incorporate changes discussed and represent the revised content to the Education and Training Committee by week 14 of the spring semester.

D. Distribution

:1. It will be the responsibility of the House President or equivalent house-‐level new member educator to ensure that every new BSC member receives a copy of the Owner’s Manual and is given a brief introduction to the manual and its contents.
:2. The Owner’s Manual should be easily accessible online.
:3. If printed, copies of the Owner’s Manual should be available at the BSC Central Office.

#General Description
The Member Education Framework is meant to be a principal guiding document for education in the BSC. It is meant to provide a high-level perspective on education priorities in the BSC, both on what topics we cover and when we cover them. This framework is meant to be useful to the general membership, as well as the members of the Education and Training committee.
This framework does not represent any education program in itself, but is rather meant to serve as a way to help eliminate redundancy, increase effectiveness, and coordinate educational programs across the BSC. Rather than creating a single strategic plan that requires future generations to follow a specific road map, this framework serves a similar planning role while allowing greater flexibility to accommodate the variable interests of future members.

It is designed to allow individuals a great deal of freedom in designing educational programs. The framework does not prescribe any specific format or process, but rather provides a view of how various topics and contexts might be arranged to ensure the most comprehensive and engaging member education. Members may interpret this document in any way they wish, given their specific desires, interests, aptitudes, and circumstances, to guide their own independent work.

#How to read the Framework
The framework is organized as a 2-dimensional grid, as follows:
##the columns represent different “contexts” of membership (new applicant, first two weeks of membership, returning member, new manager, etc), reflecting different educational needs.
##the rows represent different education topics (member rights and responsibilities, BSC history, conflict resolution, manager accountability, etc). The topics are arranged in order of most important to least important.
##every X represents a recommendation for which contexts are most appropriate for addressing the various topics. For example, it might be specifically worthwhile to address the topic of “group decision-making process” during the first two weeks of living in a new co-op. Hence, the X.

#How to use the Framework
This framework is meant to help to coordinate and inform the development of programs by providing suggestions for what topics to cover at what time. To use it, begin with either a topic or a context you wish to address.
##If you have a topic already in mind, look at what contexts that topic fits in, and decide which context is most appropriate for your purpose. From there, you can just think about the most effective medium for conveying that information in the context, and go from there.
##If you know you want to work within a specific context, take a look at what topics are recommended for that context. Then just think about ways to combine topics into fun and engaging programs that people would want to participate in. Be mindful that the topics are prioritized–please consider beginning with the higher-priority topics when developing a new program.

Once you figure out the contexts and topics, the rest is up to you! Enjoy the creative process.

#How to edit the Framework
This framework is designed to be easy to change as future generations of members take on the challenge of education on the community-wide level. As the organization evolves, the specific needs of education are always changing. You can edit the framework by either:
##adding, removing, or editing contexts
##adding, removing, or editing topics
##changing the topic/context recommendations

#Ongoing
It is recommended that this framework be reviewed at least once per year by the Education and Training committee to ensure that it reflects the current needs and capacities of the BSC. It takes a simply majority of Board to revise this framework.

Description

The BSC currently suffers from lack of clarity over the roles and responsibilities of student managers, leading to confusion over sectors of authority and accountability between Central and House-level bodies. This policy creates a working group to investigate BSC manager training procedures, sources of ambiguity related to the expectations of and for student managers, as well as methods through which managers are supported and monitored by the Central Level.

Stakeholders

BSC Board, Central Office, House Manager Teams, General Membership

Goals

To gather input from applicable stakeholders (student managers from small, mid, and large-size houses, as well as Central Level staff and student leaders) to evaluate the effectiveness of current BSC practices with regards to management training, oversight, and support. To identify areas of weakness therein. To propose strategies of improvement.
:• In particular, to address questions such as the following, and to identify solutions to consistent concerns raised:
:• How are student managers currently trained? Do various stakeholders feel this is adequate?
:• Are student managers clear about the expectations which the Central Level has for them?
:• Are house memberships informed about the expectations which the Central Level has for managers?
:• Do student managers feel they are supported by the Central Level?
:• Do house memberships feel their managers are supported by the Central Level?
:• Do house memberships feel supported by the Central Level?
:• How can we ensure that all parties are clear on the roles and responsibilities at various levels of management, and do all parties understand the proper mechanisms through which to voice concerns and look for support?
:• Do student managers feel they are supported by or in good communication with managers at other,
:• similarly-sized houses?
:• How do the management structures (and levels of compensation) of similarly-sized houses compare?
:• To what extent is manager compensation drawn from central level vs. house accounts? Does compensation have an impact on perception of management positions?
:• How do house memberships and student managers feel about routes of communication between the houses and the Central Level? What are our strengths? Ideas of improvement?
:• What changes in Board committee structure would strengthen the formal influence that House Managers wield in informing Board policy and decision-making? Should house-manager bodies like MaintCom have a more defined role in influencing the Board? How do we strengthen the influence that House Managers and House Presidents have?

Composition:
The participants of this working group will be drawn from all levels of BSC organization. It will consist of one Cabinet member-at-large, one Board rep, one House Manager, one House President, and three members at large. The Cabinet member at large will be elected by Cabinet, the Board rep will be elected by Board, the House Manager rep will be elected by the House Manager Council, and the House President rep will be elected by the Presidents Council. The chair and three members at large will be selected by the committee. The group will work along with Central Level student leadership (Cabinet/Board) for policy and procedure-related advice and support. This group will work with the Executive Director and Operations Manager as needed to ensure consistent flow of information while maintaining a bottom-up movement for evaluation and change.

Note: the ConCode frequently refers to an "Enforcement Committee" in its policies. The "Enforcement Committee" isn't an actual committee--rather, it is a placeholder term which may refer to either Cabinet, Conduct Committee, the PNG Review Committee, or the Clear and Present Danger Committee, depending on the circumstances of the individual case.

All alleged violations by current BSC members of the BSC Conduct Code (i.e. Section VII of the BSC Policy Directory) and/or conduct-related provisions outlined in the BSC Member Contract or related addendums shall be adjudicated per the process outlined in the VII.F. BSC Grievance Procedure.

All alleged violations of the BSC Conduct Code (i.e. Section VII of the BSC Policy Directory) and/or conduct-related provisions outlined in the BSC Member Contract or related addendums by a person who is currently not under a BSC Membership Contract shall be reviewed by the Central-Level PNG Review Committee as outlined in the VII.M. BSC PNG and Unit-Level PNG Policy.

All potential administrative and/or operational violations of Section II of the BSC Policy Directory, BSC Member Contract and/or related addendums, shall be adjudicated per the process outlined in the BSC Administrative Code.

“Responsible employees” are individuals who must report Conduct Code violations and other safety concerns that may pose a danger to an individual or others. Once made aware of such issues, the responsible employee must notify the BSC Central Office of the known details related to the event, as well as the names and contact information of parties involved. This notification must be made to the responsible employee’s supervisor, liaison, and/or the Member Resources Supervisor within 24 hours of finding out about the incident via email, in phone, or in person. As a result, this may reveal details about the person reporting, a person who has reached out to a responsible employee, and/or the person who has allegedly violated a Conduct Code policy. This may also reveal information about a person who is possibly a threat to themselves or others. Many BSC employees are considered responsible employees including all BSC professional staff, Board Directors, and the following unit-level managers: Presidents, Assistant Apartment Managers, House Managers, Kitchen/Food Managers, Maintenance Managers, Workshift Managers, Theme Managers, Social Managers, and Health Workers.
Guiding Documents
The Board of Directors has chosen to elevate certain statements of purpose as “Guiding Documents” for the Berkeley Student Cooperative. These Guiding Documents are not, and should not be taken as, either organizational policy or part of the mission statement for the Berkeley Student Cooperative. Instead they represent values, principles, and goals that the Board has collectively agreed to endeavor to uphold in the process of fulfilling the mission and abiding by policy.

This document is our highest-level policy document, which lays down the fundamentals of our organization and how it functions. By-Laws do things like lay out what powers board and the committees and executive have, and define the way that our meetings and voting and things like that work. These also don’t change very often, and are designed to be relatively constant and somewhat abstract.

Policy Directory
These is where the bulk of our actual policies are, and these are the ones that we typically change or add to on board. === V.I.I.A. BSC Guidelines on Accommodating Service and Assistance Animals ===

* Compliance with any laws pertaining to animal licensing, vaccination, and owner identification;
* Keeping the animal under control and taking effective action if it becomes out of control;

: - It is not housebroken (or in the case of an assistance animal that deposits waste in a designated cage or litter box, the owner fails to clean such cage or box such that the cleanliness of the room is not maintained);

: - Do not ask for details about a person's disabilities;
: - Do not pet a service or assistance animal, as it distracts the animal from its work;
: - Do not feed a service or assistance animal;

Elliehttps://policy.bsc.coop/index.php?title=Category:Section_V_-_Physical_Plant,_Maintenance,_%26_Safety&diff=3023Category:Section V - Physical Plant, Maintenance, & Safety2021-12-03T19:37:01Z
Ellie: Created page with "Category:Policy"

V.L.1. COVID-19 CO-LIVING POLICY
In response to the COVID-19 Pandemic, the BSC must adopt enforceable protocols to follow local and state orders and protect the health of BSC Members and Staff. This proposal explicates BSC-wide, enforceable member requirements for COVID-19 infection control and outlines recommendations. It defines (1) the BSC Social Distancing Protocol and (2) the BSC Health and Safety Protocols, and includes other Protocols that require every BSC Member and Staff to minimize the spread of COVID-19 in the BSC. This Policy includes enforcement mechanisms and empowers the BSC Emergency Response Team to further develop these Protocols as more government-issued orders and public health orders become available.

REQUIRED PROTOCOLS

General
:1.) In order to protect employees and members, BSC members and staff must do one of the following whenever they come into contact with outside vendors, professional staff, student staff, or unit-level managers performing essential job functions: (a) wear a mask and practice social distancing or (b) leave all space/s where essential work is being performed until the individual at work departs.

::a. The onus of this guideline is on BSC members and staff (i.e. members and staff should do this without being asked to).
::b. Masks must snuggly cover the face from the bridge of the nose over the chin and be made of a double layer tightly woven fabric.
::c. Student/professional staff, unit-level managers, and outside vendors should feel empowered to and are encouraged to request that members and staff follow this protocol.
::d. If an individual refuses to do (1) or (2), staff, unit-level managers, and vendors have the right to notify their supervisor and leave the environment until employee safety can be ensured.
::e. Members and staff who are able to safely wear masks are expected to have a mask with them at all times.

:2.) Masks must be worn at all times inside Central Office, Central Food & Supplies, the Rochdale Fenwick Office, BSC vehicles, and while performing central-level job duties, except for the following exceptions:

::a. When employees are alone in private offices where others are not likely to enter.
::b. When speaking on the telephone or video conferencing, provided others are not within six feet and they are not at a shared desk.
::c. In designated break areas when eating and drinking.

:3.) Staff, members, and/or vendors who are not able to wear masks for health-related reasons should contact the Human Resources Manager (for staff/vendors) or the Housing Supervisor so that appropriate accommodations can be made to provide services while also protecting the health and safety of others present.

:4.) Members must wear masks in the common space of all units whenever possible (e.g. not required in showers, when brushing teeth, eating, etc. provided that occupancy limits and social distancing requirements are observed).

:5.) Members must practice social distancing (6 feet distance) in common areas whenever possible.

:6.) Unit Presidents must notify the Cooperative Experience Manager by the end of Week 2 of any unit-level policies their Council passes related to COVID-19.

:7.) Non-resident guests at Houses are not allowed, unless House Council votes to make an exception.

:8.) Members at apartments at Northside, Rochdale and Fenwick must receive approval from all roommates prior to a guest visiting.

:9.) Exceptions to these guest policies for health or disability reasons can be made by contacting Betsy, the Housing Supervisor.

:10.) All guests must abide by relevant BSC and unit-level COVID-19 policies and member hosts are responsible for ensuring compliance as a prerequisite to maintain guest privileges.

:11.) Non-resident guests at Houses are not allowed, unless House Council votes to make an exception. Houses must have a bathroom assignment plan that includes provisions for high-risk members and guests. This bathroom assignment plan will be made in consultation with their liaison for a House to have guest exemptions. Houses must comply with all applicable local ordinances and laws.

Events and Informal Gatherings

:1.) All common spaces (indoor and outdoor) in houses will have a maximum occupancy limit of 6 people. Occupancy limits of greater than 6 people for large common rooms and/or outdoor areas may be proposed by Unit Presidents and approved by the ERT. Accordingly, all gatherings within common space must abide by the occupancy limits.

:2.) Apartment managers will work with their Unit Liaison and the ERT to determine the occupancy limits of their common space.

:3.) Unit-level Managers may not organize, assist, or encourage in-person indoor events or gatherings of any kind, including parties, dinners, and Council if larger than established occupancy limits for the indoor space.

:4.) Unit-level Managers may organize, assist, and encourage in-person outdoor events and gatherings under the following circumstances:

::a. On BSC property: Exclusively outdoor and within the occupancy limit of that space. Members should wear masks and practice social-distancing at all times. Guests from outside of the unit are not allowed.

::b. Off BSC property: Members should wear masks and practice social-distancing at all times, including following any COVID-19 guidelines listed for that space.

:5.) Unit-level Managers may organize, assist, and encourage virtual events (e.g. virtual council).

:6.) The Member Resources Supervisor (liaison for Social Managers) and the Social Manager Coordinator are empowered to make temporary adjustments to Social Manager job duties to meet the unique needs of members and manager teams during the pandemic.

::a. These adjustments should be reported to the Experience & Training Committee so that ETCom may review them, if needed.

Food Service
:1.) Cooks, members serving dinner, and kitchen workshifters must wear masks at all times.

:2.) Houses must implement staggered meal times, serving dinner “cafeteria style”, (with one person serving each food item to everyone else), or other strategies to minimize risk during meals, (e.g. serving dinner outside if possible).

:3.) Houses will issue individual utensils and dishware and implement policies to give extra care to sanitizing communal utensils and kitchenware.

:4.) Do not share drinks, eat off of others’ plates, or share utensils with others without thoroughly washing them.

:5.) Do not touch any bulk food items (e.g. cereal, bread, dried fruits/nuts, etc.) with bare hands.

:6.) Do not leave food out on “free tables”.

Free Piles
:1.) Managers will continue to keep all free piles closed.

:2.) Members will not deposit or take items from the free pile.

Self Isolation & Quarantine Procedures

:1.) Members directed by University Health Services or the Berkeley Public Health Division to self-isolate or quarantine must follow the instructions given by the ERT and/or Covid Action Team.

:2.) All residents moving in for the Fall 2020 contract who did not reside in the BSC during the summer must sequester for 7 days. This includes:

::a. Staying in their room as much as possible. Members may not spend time in indoor common space, but can use outdoor common space if they are alone.

::b. Using their designated bathroom.

::c. Wearing a mask whenever they are outside of their bedroom.

::d. Staying out of the kitchen. Food will be delivered to them. [Required for Room & Board houses only]

:3.) The ERT will create a small working group to support African American Theme House, Person of Color Theme House, Sherman, and/or other units with a high number of new members with their new-resident sequestration protocols.

::a. Group must seek input from incoming managers at each of the above units

::b. The working Group will consist of the Cooperative Experience Manager, unit liaison, and Covid Action Team.

Education for Required Protocols
To ensure that all members understand these requirements and have opportunities to ask questions and provide feedback:

:1.) Signage displaying the requirements must be posted in a visible location at every BSC property prior to the Fall 2020 move-in day. Central-level staff are responsible for creating the signs and Health Workers are responsible for posting them.

:2.) Manager teams must review these requirements during their unit’s first council meeting.

:3.) All members will be emailed a copy of these requirements by the Housing Department within a minimum of 7 days prior to the Fall 2020 move-in day.

:4.) The Member Resource Supervisor is directed to include this information in New Member Orientation materials.

RECOMMENDED PROTOCOLS

:1.) Members are encouraged to seek testing prior to or immediately upon arrival during their self-sequester period.

:2.) Members who test positive, experience symptoms, were directed by a medical or public health provider to get tested, or were exposed to someone who tested positive should heavily consider following BSC protocol for reporting to the ERT and unit-level managers.

:3.) Development of “social bubbles” within houses.

:4.) Unit-level managers should support and encourage frequent COVID-19 testing by members.

:5.) Unit-level managers should support non-UCB membership in identifying COVID-19 testing resources with the support of the ERT and the Covid Action Team.

:6.) Members are encouraged to socialize in outdoor spaces whenever possible.

:7.) Opening windows (to increase ventilation) while socializing indoors when possible.

:8.) Members should be mindful of their activities outside the house (i.e. attending large parties or gatherings in other places) and should shower and change clothes upon returning.

:9.) Follow the guidelines given in the BSC Health and Safety Protocol

:1. Define the numbers of members that must be trained for each house, and state explicitly the responsibility of the house-level management in being one of the trained members of each house. The area of training shall include, but not restricted to, search and rescue, first aid, and fire suppression.

:2. Define the process for which each house shall follow to inventory the emergency response kit (ERK). The content of this kit shall be reviewed by House Managers under the supervision of the Member Resource Coordinator (MRC) every semester, with a planned review and circulation of expired materials to occur every summer.

:3. Established a regular meeting for major stakeholders in the BSC emergency plan such that they can review existing plans and consider modifications.

V.K.2. THE INVENTORY PROCESS
• As a part of the requirements of the position, the House Managers will become responsible for taking inventory of the ERKs at each house. The House Manager is required to take the inventory of and order necessary supplies for all houses’ ERKs once per semester which will be done in collaboration with the MRC.

• Every semester, the Cloyne Facilities Manager, Rochdale Facilities Manager, Member Resource Coordinator and any other interested or affected parties will review the readiness plan, current state of supplies, inventory and note sites for resupply. It is strongly recommended that the Executive Director and Operations Manager attend these meetings as well.

• To make the process more efficient, the House Manager should use assistant(s) to take inventories. This assistant can be a House President or any member from the house. Any assistant who helps take inventory will receive HI or workshift compensation for their time (as determined by their house management).

• By week 6, House Managers must locate their respective ERK and must place a copy of their house Emergency Preparedness plan there, along with emergency contact information of house members. In addition, a copy of the house Emergency Preparedness plan must be made available to all house members for their personal review. By week 11, they are required to provide the Member Resource Coordinator with an inventory of the ERK. House Managers who do not do so will be at risk of losing 5% of their central level compensation.

• The Member Resource Coordinator is required to order any supplies needed to adequately stock the ERKs (per the Emergency Kit Necessary Materials list), ordering as many supplies as is possible through CK, and notify House Managers of the approximate date of arrival of supplies, as well as provide them with a detailed bill of all items ordered and the cost of each.

• Houses are responsible for financing the restocking of their ERK, determining with the accountant for the BSC and the Member Resource Coordinator which house account they would like the supplies to come from.

• House Managers will remain responsible for changing the water in their water barrels once every 1-2 years.

• The Emergency Kit Necessary Materials list shall be changed to include only the amount of supplies that are necessary to adequately serve the house in the case of an emergency, eliminating superfluous supplies. The MRC maintains a list of these supplies (see attached sheet).

V.K.3. THE MEMBER'S TRAINING PROCESS
Community Emergency Response Team (CERT) Trainings

• Each house must send their House President, House Managers and Maintenance Managers to at least one CERT Training held by the Berkeley Fire Dept; other managers are encouraged to attend.

• Each house will be required to send at least 3 managers, with 5 required for large houses (Cloyne and CZ), Fenwick, and Rochdale, to CERT Trainings. It is strongly recommended that managers evenly attend Search and Rescue, Disaster First Aid and Fire Suppression.

• The Member Resource Coordinator is responsible for, at the beginning of the semester, reminding House Managers of the minimum member training requirements of their house and directing them to the site where training dates are posted.

• The House Manager will become responsible for ensuring that their minimum member requirement is met and will themselves send in registration requests to the Berkeley Fire Dept, copying the email to the MRC.

• Each member who attends a CERT training must bring back a form signed by a CERT instructor to the MRC by the 11th week.

• Managers/members who register for training and cannot attend must find a replacement from their house to attend in their place or notify the Berkeley Fire Dept in advance that they will not be making it. They must also notify the MRC of any changes made. The Berkeley Fire Dept will provide the MRC with a list of those co-op members who did not attend the trainings that they registered for. Any members who did not arrange for a replacement or give the Fire Dept advanced notice that they wouldn’t be making it will be fined. The Member Resources Coordinator will fine houses $25 for each no show, and House Managers may choose whether or not to levy the fines to the individual member who did not
attend.

• All House Presidents, House Managers, and Maintenance Managers who do not complete their CERT training requirement (attending at least one training each semester) shall be fined according to the central level manager oversight policy of a fixed $50 compensation loss for each manager that does not complete the CERT training, as determined by the Member Resources Coordinator.

• The House Manager is to supply the names of the trained people to C.O. and C.O. is to keep an active list of trained people in each house.

Member Training Video

• The MRC is responsible for showing the video to managers at managers training.

• All BSC members need to watch the video at least once during their membership.

• The MRC is responsible for providing emergency information to members that is specific to the cooperative community during the showing of the video to make it more appropriate to the BSC.

• It is recommended that the MRC conduct inventories in tandem with the Habitability Inspections process (Contact the Operations Manager for more info).

Emergency Evacuation Drill

Houses are required to complete an emergency evacuation drill by the 7th week of each semester, to be led by the House President in collaboration with other managers and the MRC. The drill shall include:

:1. A presentation at a house council preceding the drill, including the following information: fire and earthquake response procedures; the locations of all exits, fire escapes, evacuation routes, fire extinguishers and fire alarms; the location of the e-kit, water barrels, and food cache; the location of the emergency assembly area; a review of the roles and responsibilities assigned in the House Emergency Plan.

:2. A drill which simulates an emergency evacuation. Separate fire and earthquake drills can be held or they can be incorporated into one drill. Aspects to be included in the drill are: how to respond to an earthquake; all possible evacuation routes; a run-through of the roles assigned in the House Emergency Plan; house assembly at the emergency assembly area. The drill must include practice of plans for disabled persons in all houses (for both ADA and non-ADA accessible houses this include plans for the deaf and blind). Optional: The use of mock injured persons during the drill to simulate a real earthquake and multi house drills utilizing the disaster caches.

:3. Participate in a coop-wide emergency drill whose date and nature is decided by ETCom.

Directive for Central Level Moving Forward

• Central Level has determined that we shall create 3 locations to house food supplies to be used for the entire membership
in the event of a large-scale emergency. Food will be stored in a shed in a parking spot at Northside Apartments, in a parking
structure at Oscar Wilde, and in a shed at Rochdale. There will be enough food (2000 calories per day) for every member
for 3 days. The food will be inventoried and rotated by central warehouse staff annually.

• Annually, the Member Resource Coordinator will be responsible for designating a BSC on-call or other employee to review the contents of the food caches in question and will arrange their replenishment according to need, in collaboration with CFS, who will order the supplies. Soon-to-be-expired food will be redistributed and billed to the houses.

A. AWARDING OF POINTS
1. Points shall be awarded to the general membership in order to determine seniority when bidding on rooms within individual units and transferring from one unit to another.

2. Members with rental contracts shall receive points as follows:
:a. In the Fall and Spring contract periods, one point shall be awarded to members who have resided in the BSC for at least 42 contiguous days during that contract period.
:b. In the Summer contract period, three-fourths of a point shall be awarded to members who have resided in the BSC for at least 42 contiguous days during that contract period.

3. For members with a disability who require a live-in attendant, the application number for the live-in attendant space will accrue BSC seniority points according to standard BSC policy. Such seniority points are tied to the member’s live-in attendant space and not any individual(s) who may occupy it.

4. Members who do not meet these conditions for the awarding of points but can present exceptional and compelling circumstances may appeal their cases to the Administrative Committee.

B. ROOM BIDS – HOUSES
1. Points are considered “active” and “inactive” for the purpose of bidding on rooms within individual houses.
:a. When a member first transfers to a new house, points are inactive. Points are activated four weeks after moving in. Points remain active for as long the member resides in the house. A member does not have to reside in the house during the summer session in order to retain active points.
:b. The time period after which the points of a member who leaves the BSC become inactive is at the discretion of each house, providing the following minimal guidelines are followed: members who leave the BSC due to documented health issues or emergencies, education abroad, educational exchange, or military service and then return to their original house will still have active points providing that the members return within a year of the cessation of said event or occurrence. (See Section IV if a member has left and returned to a house without leaving the BSC.)
:c. Members who are forced to transfer to a different unit due to temporary or permanent closure of their original unit shall have their points in the new unit activated immediately. The next semester’s room bids shall be made with the full participation of all members transferring from the inoperable unit.
:d. It is at the discretion of individual units to determine a point activation policy in the case where a member has previously resided in that unit, chosen to relocate to a different unit for at least one fall or one spring semester, and then chosen to move back to the original unit. However, such practices should be documented in the unit's constitution. In the case where no policy in the unit constitution encases this scenario, then the following default rule will be used: A member's points shall be split into active and inactive portions, with the active portion equal to the points received while residing in the original unit.

2. Room bids shall adhere to the policies below.
:a. When bidding on an available room (a “desired room”), the individual or group of individuals who wish to occupy a desired room shall be called a “bidding unit.” The bidding unit with the greatest aggregate active points shall receive the desired room. Ties shall be broken first by including any inactive points in each bidding unit's aggregate points. Units may decide how to break further ties after using active points and inactive points, provided that such practices are documented in the unit's constitution. If a unit's constitution does not specify how to resolve a tie after inclusion of inactive points, and if such a tie occurs, the bidding unit with the lowest average application number wins the bid.
:b. It is the responsibility of individual units to establish room-bid procedures that adhere to these guidelines.

3. Room Bids at Apartment Units: See the Rochdale, Fenwick, and Northside Constitutions.

4. Squatter’s Rights: A “squatter” is someone who has bid into a room and has a right to remain in that room during future semesters even if another member who has more points also desires the room. A member may squat in a room from Fall to Spring, and from Spring to Fall. However, members beginning in the Summer do not have squatter’s rights and must bid on a room in the Fall.
:a. Only members in need of wheelchair accessible accommodations shall have squatter’s rights in a wheelchair accessible apartment or bedroom.
:b. If no member with disabilities needs a bedroom/studio reserved for members with disabilities at a unit, then any member may bid on the room but they shall not be granted squatter’s rights for any future semester.

C. ROOMMATE COMPATIBILITY:
1. Members are guaranteed roommates of their own gender if they wish. The BSC will not release a member from their contract/lease obligations due to their roommate’s age, physical disability, ethnic background, marital status, national origin, political affiliation, race, religion, or sexual preference.

2. Members shall be released from their contract/lease for roommate incompatibility only if they demonstrate to the satisfaction of AdCom that the incompatibility significantly interferes in their life and that possible alternatives, such as room switches in units and switches between units, have been considered.

D. ACCOMMODATIONS FOR MEMBERS WITH DISABILITIES: ASSIGNMENT
1. A student who has a verified disability and needs an accommodation of a single room must provide verification of their disability and their need for a single room to the Housing Supervisor who will determine what reasonable accommodations can be offered and notify the House Manager of the member’s need for a single room. For specific details on requesting and receiving housing accommodations please see section IV.__ Guidelines for Receiving an Accommodation.

2. The BSC will reserve at least one single room in each room and board house and one studio at Rochdale for members needing the accommodation of a single room. The number of reserved single rooms will vary by house, depending on the overall number of single rooms available at the house. Houses with a greater number of single rooms will proportionally have a greater number of single rooms reserved for members needing the accommodation of a single room. Houses that are all single rooms by design shall have no set number. The number of single rooms reserved at each house shall be:

{| class="wikitable"
|-

Houses with a wheelchair accessible room(s) must still reserve a disability single in addition to the wheelchair accessible room(s). Individual houses can decide to reserve a specific room or leave the last single open as the guaranteed single for members with disabilities. The room must be held open until room bids at the beginning of each semester. If a house has two rounds of room bids, then they must reserve a single room for a student with a disability until the second round of room bids. If no member with disabilities needs the room, then any house member may bid on the room but they shall not be granted squatter’s rights for any future semester. The Rochdale studio will be held until special bids at the beginning of each semester, then released to the general membership if it is not required. The member who gets the room or the studio at bids shall not be granted squatter’s rights for any future semester.

3. Members with a verified disability are also allowed to participate in room bids using their points, if they so desire, and are allowed to bid for a different single than the one they were guaranteed. The member does not have to live in the reserved single if they choose to attain a different single through room bids. If a member is able to bid into a room through points, then that room shall no longer be considered a reserved disability single, and a separate single shall be reserved for a member with disabilities so that they may receive a single room accommodation regardless of seniority points priority.

4. If, during room bids, the member chooses a room different than the one provided to them by the BSC per their accommodation request, they forfeit their accommodation and must request it again should they decide they need it for future semesters. By forfeiting the offered accommodation, the member is indicating that they do not need the offered accommodation for the current term and they will not be guaranteed an offer for a difference space.

E. LIVE-IN ATTENDANTS FOR MEMBERS WITH DISABILITIES
:1. The BSC contracts for live-in attendant spaces with the BSC member who requires a live-in attendant as a housing accommodation, not with any individual(s) providing live-in attendant services. As such, the BSC has no direct relationship with the live-in attendant.
:2. The member requiring live-in attendant services may hire, terminate, and/or supervise their attendant at their discretion.
:3. The BSC assumes no responsibility for the working conditions or any agreements between the member and attendant.
:4. Live-in attendants must follow all unit-level and BSC policies. The member employing the live-in attendant is responsible for ensuring they do so and/or taking appropriate remedial action.
:5. For information regarding the accrual of points and unit/room assignment for live-in attendants, please see section VII.A.3 and VII.D, respectively.

Section I: BSC Membership
I.A. Membership Eligibility Categories1
1. Student Status: The status of any registered, full time students working toward an academic degree or teaching certification at a post-secondary school. The academic degree program must be progressive2 from any previous such programs the member has completed. The BSC recognizes four such subcategories:
:a. University of California, Berkeley Students: Any registered student at UCB as of 5:00pm on the last day UCB normally allows a student to withdraw from the current semester without losing eligibility for re-admission for the following semester. This subcategory includes students in the UCB Freshmen Extension Program3.
:b. Graduate students on filing fee status.
:c. Other Students: Any full time registered student that meets the BSC student status requirement according to the definitions (such as “full time” or “degree program”) used by the specific school attended by the student. Because community colleges do not enforce student progress toward an academic degree, members are allowed a maximum of six semesters in the BSC as community college students. For students continuing to pursue a recognized academic goal, AdHoc may approve an additional semester(s).
:d. Visiting Student Researchers (who are currently enrolled in a degree program and are working to obtain a degree) meet BSC student eligibility requirements. Postdocs and Visiting Research Scholars (who have already obtained a PhD), however, do not meet BSC student eligibility requirements. Updated by Board 5/07/20

2. Grace Status: The status of any person who does not meet the student status requirements of section I.A.1 but is deemed by the BSC to be part of the student community in accordance with the guidelines below. Members are allowed a maximum of three grace semesters. No person may live in the BSC in consecutive grace semesters, except for preparatory grace. No member shall be eligible for a grace semester their first academic semester in the BSC. The BSC recognizes five such subcategories:
:a. Spring Grace: Any person who resided in the BSC during the preceding fall semester, under the provisions of IA1, Student Status or I.A.2.(e), Preparatory Grace Status may reside in the BSC in the Spring.
:b. Fall Grace: Any person who both resided in the BSC during the preceding spring semester under the provisions of IA1, Student Status or I.A.2.(e), Preparatory Grace Status and will be eligible under the provisions of I.A.1, Student Status or I.A.2.(e), Preparatory Grace Status the following Spring semester. To receive a contract for the following Spring semester, the member must demonstrate to staff before the Friday following the Thanksgiving holiday that they will qualify for membership under the provisions of I.A.1, Student Status or I.A.2.(e), Preparatory Grace Status. Members who fail to do so shall lose their reservation rights and be terminated immediately.
:c. Incomplete Units Grace: Any person working to complete at least six units of incomplete class work at a postsecondary school in that semester. This category includes non-registered students. (This particular status may only be granted once.)
:d. Fall Degree Completion Grace: Any person graduating at the end of the fall semester who needs to take only the courses they are enrolled to complete a degree. This category includes non-registered students. (This particular status may only be granted once.)
:e. Preparatory Grace: Any person who has graduated from a post-secondary school and is working in preparation to begin another degree program or is otherwise seeking academic preparation in accordance with the guidelines below. Such grace semesters count towards the maximum number of three grace semesters overall. No member shall be eligible for a preparatory grace semester their first academic semester in the BSC. Only members who would commence prep grace status in a consecutive academic term would be eligible for preparatory grace5. Studying for a qualifying exam and work that merely improves one’s chances of admittance shall not be considered required work.
::i. Academic: The member must be enrolled as a full-time student or in an equivalent number of units to a fulltime student. (No more than 49% of one’s units may be through online/distance learning.)
::ii. Non-academic: A member building a portfolio, doing research or other non-academic work qualifies for a preparatory grace semester if this work is unpaid, required for admission to the degree program, and involves a minimum of twenty-two (22) hours of work per week.
::iii. Mixed:6 A member enrolled in fewer than five semester units which are required coursework for the degree program, but is doing non-academic coursework required for the degree program which involves a minimum of two and a half (2.5) hours of unpaid work per week for each deficient unit of required coursework.

I.B. Unit Eligibility
Only UC students may live in units leased from the University. This includes the summer term for Cloyne. In the summer, non-UCB students may reside in Rochdale, Fenwick and Convent.

I.C. Summer Eligibility
Students meeting any of the following requirements may reside as a member in the summer: Any student enrolled for the summer; Any student who met the status requirements of IA1 Student Status or IA2 Grace in the prior Spring; Any student who can document that they will meet the status requirements of IA1 Student Status or IA2 Grace in the following Fall. To be eligible to live in Cloyne, residents must be enrolled in at least 5 units of UCB summer session or must be able to verify that they were UCB students the preceding Spring or will be UCB students the following Fall.
