VII.Q. BSC Anti-Bullying Policy


I. Policy Statement & Definition:

A. The BSC strives to create and maintain a community in which people are treated with dignity, decency, and respect. The BSC community should be characterized by mutual trust and the absence of intimidation, degradation, or humiliation. Members should be able to live, board, and learn in a safe and stimulating environment. The accomplishment of this goal is essential to fulfilling the mission of the BSC. For that reason, the BSC will not tolerate abusive behavior and/or bullying of any kind. Through enforcement of this policy and through the education of members and guests, the BSC will seek to prevent, correct, and discipline behavior that violates this policy.
B. The BSC defines abusive and/or bullying behavior as persistent, malicious, unwelcome, severe and pervasive mistreatment that harms, intimidates, offends, degrades or humiliates a member whether physical, verbal, written, graphic, in person or via electronic messages or media posted or circulated in any form in the BSC community.
C. The BSC promotes and is committed to providing a safe and cooperative community and strictly prohibits abusive conduct and bullying.

II. Applicability

A. All members, guests, alumni, and third-parties conducting business with the BSC are expected to comply with this policy, and to take appropriate measures to ensure that prohibited conduct does not occur. Appropriate disciplinary action will be taken against any member, guest, alumni, or third-party that violates this policy. Based upon the seriousness of the offense and the nature of the individual’s relationship with the BSC, disciplinary action may include a warning, educational sanctions, a conditional contract, membership termination, ineligibility to visit BSC property, and/or ineligibility to conduct business with the BSC.
B. Please see the BSC Harassment Policy for policies and procedures governing inappropriate conduct predicated on an individual or group’s protected status.
C. Please see the Anti-Bullying & Abusive Conduct Prevention Policy in the BSC Employee Handbook for relevant policies providing protections and outlining expectations and accountability for BSC student and professional staff in the workplace.

III. Examples of Prohibited Abusive Conduct and/or Bullying

A. The BSC prohibits abusive conduct and/or bullying behavior that a reasonable person would find:
i. Has the purpose or effect of creating an intimidating, hostile, or offensive educational, living, or boarding environment; or
ii. Has the purpose or effect of unreasonably interfering with an individual’s academic performance or their ability to exercise their rights and/or fulfill their responsibilities as a BSC member, guest, alumni, or third party providing services within the BSC community.
B. Examples of unacceptable behavior (whether physical, verbal, written, graphic, electronic messages or media posted or circulated in the community) include the following types of conduct:
i. Repeated infliction of verbal abuse, such as the use of derogatory remarks, insults, epithets, persistent or egregious use of abusive, insulting, or offensive language.
ii. Staring, glaring or other nonverbal demonstrations of hostility as a pattern of other behaviors consistent with this policy.
iii. Personal attacks, behavior, or language that frightens, humiliates, belittles, or degrades, including criticism or feedback that is delivered with yelling, screaming, threats, or insults.
iv. Gratuitously insulting another person or their performance, especially in front of others.
v. Spreading misinformation or malicious rumors.
vi. Making repeated inappropriate comments about a person's appearance, lifestyle, family, or culture.
vii. Regularly inappropriately teasing or making someone the brunt of pranks or practical jokes.
viii. Inappropriately interfering with a person's personal property or work equipment.
ix. Circulating inappropriate or embarrassing photos or videos via e-mail or social media.
x. Unwarranted physical contact.
xi. Purposefully and inappropriately excluding, isolating, or marginalizing a person from unit or BSC-wide activities.
xii. Consistent ignoring or interrupting of a member.
xiii. Encouragement of others to turn against a targeted member.
xiv. Invasion of another’s person’s personal space.
xv. Unreasonable interference with an member’s ability to study or do their workshift.
xvi. Conduct that a reasonable person would find hostile and offensive.


IV. Reporting Abusive Conduct and/or Bullying & Enforcement

A. If any member, guest, alum, or third-party conducting business with the BSC feels that they are being subject to abusive conduct or bullying or if they observe abusive conduct or bullying by another member, guest, alum, or third-party doing business with the BSC, they should immediately report the incident to a member of their unit-level manager team, the Cooperative Experience Manager, or the Member Resources Supervisor in order for appropriate action to be taken.
B. Early reporting and intervention have proven to be the most effective method of resolving actual or perceived incidents of bullying. The BSC will make every effort to stop bullying before it becomes severe or pervasive, but can only do so with the cooperation of members of the BSC community.
C. In order for the BSC to investigate and try to resolve complaints internally, all parties must promptly report complaints of misconduct under this policy to the Cooperative Experience Manager or the Member Resources Supervisor. All complaints should be submitted via the BSC Conduct Complaint Form, via email, or by calling (510) 848-1936. All complaints of abusive conduct and bullying that are reported will be investigated as promptly as possible and corrective action will be taken where warranted.
D. The investigation and resolution of complaints will be conducted in accordance with:
i. The BSC Grievance Procedure (for current BSC members)
ii. The BSC Central Level PNG Policy (for alumni, guests, or third-party conducting business with the BSC)

V. Direct Communication

The availability of this complaint procedure does not preclude individuals who believe they are being subjected to abusive behavior and/or bullying from promptly advising the offender that their behavior is unwelcome and requesting that such behavior immediately stop.
